JACKSONVILLE, Fla. -- The man who died following an incident in a motel had been in trouble with police for a similar incident in the past year.

Overnight at the Red Roof Inn on Youngerman Circle, police responded to a disoriented man complaining in the parking lot. The Jacksonville Sheriff's Office has identified him as Curtis James Moss.

Police said the 28-year-old retreated to his room with his girlfriend, but he was unstable and they took him into custody.

When they got Moss out of the room, police said, he struggled with them.

Chief John Hartley said officers held Moss to the ground and tried to use a total restraint appendage or TAR on him but were only able to get it around his legs.

Hartley said no Tasers or police baton were used in the incident.  Police say Moss' girlfriend and a hotel security guard have signed sworn statements stating the Tasers and baton were not used.

Hartley said after police had Moss on the ground he then showed signs of medical distress. He was taken to Orange Park Medical Center where he was pronounced dead.

First Coast News has learned this is not the first run-in Moss has had with the police.

A police report from 2010 showed Moss was arrested at a Southside hotel after a disturbance. Numerous officers were called in to try and restrain him; officers had to use their Taser at least twice on Moss because they were unable to control him.

Officers placed him in the TAR restraint, from which Moss was able to escape. Other officers were then called in to help. 

According to that report, Moss told police he had been drinking and had "ingested some cocaine."

Hartley said Moss' latest incident with police and his death are under investigation.

Officers involved have been placed on administrative leave which is standard procedure in cases like this one.

The Medical Examiner says Moss' cause of death is still pending.
